  • General Purpose AI (GPAI): Including those that are expected to have a high impact (GPAISR). 

For non-compliance, the fines are eye-watering: up to €35 million or 7% of worldwide annual turnover for prohibited AI. Even if you’re not in the EU, these regulations could still apply if your AI systems touch EU markets. And the UK isn’t far behind with its own evolving guidelines and best practices.

To ensure you are using AI responsibly it is worth considering some of the following areas: 

  • Have you agreed what AI means to your organisation, and do you have an AI Policy that makes it clear to staff how AI should be used? 
  • Are you risk assessing any new AI solutions to ensure all data protection and information security risks have been considered? 
  • Are you clear how AI solutions used in your business are processing personal data and can you explain this to individuals whose data you process? 
  • Have you asked suppliers providing the AI solution how they manage key risks in this area? 
  • Have you ensured that any AI solution deployed is accurate, reliable, safe, ethical, lawful, free from bias and includes some form of human oversight?
